The Radiology working committee set up by the\nIndependent Association of Dentists (AIMD) and the National Association of\nClinics (ANC) is organising a protest action for 18th<\/sup> June against\nthe new legal regime for radiological protection.<\/p>\n\n\n\n

The protest, scheduled for 3pm, will take place on Rua\nde O S\u00e9culo in Lisbon, in front of the headquarters of the Ministry of the\nEnvironment and of the Inspectorate-General for Agriculture, Sea and Spatial\nPlanning (IGAMAOT.)<\/p>\n\n\n\n

In a press release, the president of the AIMD said: \u201cThis\nis a time to unite all doctors, dentists and vets under a common banner. The\nrequests for help that reach us multiply, they are too many for us not to act\ndrastically. Health and clinics cannot remain hostages of bureaucrats and fees.\nWe ask this government, that systematically discredits the professional\nassociations, listens to health professionals and has the courage to reverse\nthis absurd legislation, which treats medical clinics like nuclear power\nstations.\u201d<\/p>\n\n\n\n

The two associations have made a public petition<\/a>, with the same purpose, which less than a day after its launch has already\nexceeded a thousand signatures, and will be handed over to the Ministry of the Environment\nat the end of the protest.<\/p>\n\n\n\n

According to the two associations, \u201cthe DL 108\/2018 is\nmanifestly ill-adjusted to the reality of radiological examinations performed\nin Portugal, it went beyond the requirements of European Directive Euratom\n2013\/59. (…) This has created the chaos of bureaucratisation and led to\nastronomical inflation of the fees charged by radiological protection\ncompanies, all as a result of a law that cannot be fulfilled in a timely\nmanner.” <\/p>\n\n\n\n

They add: “Naturally, oral radiology must be\nregulated, but not in a witch-hunt with fines of tens of thousands of euros, as\nif we were dealing with environmental disasters. In Portugal, there has never\nbeen the slightest incident resulting from ionising radiation from dental radiology\nequipment!”<\/p>\n\n\n\n

In May 2021, the Portuguese Environment Agency (APA),\nthe Order of Dentists (OMD) and the Order of Veterinary Doctors (OMV) reached\nan agreement regarding the revision of DL 108\/2018, in which an 18-month\nmoratorium applicable to clinics was contemplated. “However, IGAMAOT\ninspections have been maintained, which is completely incomprehensible,”\nadd the spokespersons of the ‘task-force’. “With the chaos installed,\nthose who profit are the APA itself, through IGAMAOT, which actively inspects and\napplies administrative offences for mere bureaucratic reasons, without any\nimplicit risk to public health.”<\/p>\n\n\n\n

This ‘task-force’ has therefore put the following\ndemands to the Government: immediate revocation of DL 108\/2018; immediate\nsuspension of IGAMAOT’s inspection activity; cancellation of all ongoing\nadministrative offence procedures applied to private health providers by\nIGAMAOT.<\/p>\n\n\n\n

The protest action and the petition follow a report to\nthe Public Prosecutor’s Office made by these associations targeting IGAMAOT, in\nApril 2021, and the case is already under investigation by the Central\nDepartment of Investigation and Penal Action (DCIAP). One of the complaints\nmade is the violation of the principle of equality in a rule of law:\n“according to IGAMAOT’s own inspection reports, made available on its\nwebsite, they show that, at least in 2019 and 2020, they only inspected private\nentities”.<\/p>\n\n\n\n
